Part 1 — The Plain-English Version

A quick, friendly summary of what you're signing up for. This is just an overview — the full Terms of Service and Privacy Policy below are the legally binding documents. If anything conflicts, the full Terms win.

💵 The price. Your plan is $150/month plus a one-time launch fee. Both renew/bill automatically. The launch fee and monthly fees are non-refundable, including partial months. We can change pricing with notice.

📦 What "Basic" means. $150/month is our entry-level, limited plan. Every service is delivered at its simplest standard level — think a small, template-based static website, basic shared hosting, a basic SSL certificate, one (1) business email, one logo concept, a templated monthly report, and a capped number of small tasks. Nothing custom, dynamic, or unlimited is included unless you buy an upgrade.

🔒 Security & accessibility. We provide solid baseline protection and good-faith accessibility efforts, but we don't guarantee uptime, security against attacks, or legal compliance (ADA/WCAG). You're responsible for your own compliance.

🗂️ Your data. We take routine backups, but keep your own copies too — we don't guarantee data recovery and aren't liable for data loss.

🦍 Who owns what. We own our platform and the systems behind it. Your finished website and assets are licensed to you while your subscription is active and paid. If you cancel or stop paying, that license ends and we can disable or reclaim the work. We may also feature your project in our portfolio.

🛑 Our rights. Pink Gorilla can suspend, pause, change, or cancel services or your account at any time, at our discretion, especially for non-payment — with no refunds.

🚪 Cancelling. You can cancel anytime with 30 days' written notice; it takes effect at the end of your paid term. No refunds or prorations.

⚖️ Disputes. Governed by California law, resolved by individual arbitration in Los Angeles County, with a jury-trial and class-action waiver.

Part 2 — Terms of Service & Service Policy

1. The Agreement

These Terms, together with any order form, invoice, launch agreement, or written scope we provide, form the entire and exclusive agreement between you and Pink Gorilla. They supersede all prior or contemporaneous proposals, emails, conversations, marketing statements, or representations, whether oral or written. Marketing language on our website (including phrases such as "An Entire Agency," "powerful online presence," "relentlessly modern," "enterprise-grade," or "all included") is descriptive only and does not create an actionable warranty or expand the scope of the Basic Plan.

2. Plan Structure, Fees & The Basic Tier

2.1 The $150/Month Plan ("Basic Plan")

The advertised price of $150 per month refers to the Basic Plan only. The Basic Plan is an entry-level, limited-scope package. It is intentionally capped, standardized, and templated. Unless you have purchased a separately quoted upgrade, every Service described is delivered at its Basic tier, meaning the smallest, simplest, most limited version of that Service that Pink Gorilla offers.

2.2 Launch Fee

In addition to the recurring monthly fee, a one-time non-refundable Launch Fee is required before any work begins. The Launch Fee covers onboarding, initial setup, provisioning, and configuration. The Launch Fee is fully earned upon payment and is non-refundable under any circumstances.

2.3 Billing, Auto-Renewal & Authorization

• The monthly fee is billed in advance on a recurring basis and automatically renews each billing cycle until cancelled.
• By providing a payment method, you authorize Pink Gorilla to charge that method automatically for all recurring fees, the Launch Fee, taxes, overages, and any additional services you approve.
• All fees are non-refundable, in whole or in part, including partial months.

2.4 Price Changes

Pink Gorilla may change pricing, fees, or the contents of any plan at any time and in its sole discretion. We will use reasonable efforts to notify you of material price increases.

2.5 Late Payment & Suspension

If any charge fails or a payment is more than three (3) days late, we may, without notice and without liability: suspend or disable your website, hosting, email, and all Services; withhold deliverables; and/or begin the de-provisioning process. A reactivation fee may apply.

3. Scope of Services — What "Basic" Includes (And Does Not)

The following describes each Service at the Basic Plan tier. Each Service is provided at a baseline, limited, standardized level. Anything not expressly listed as "Included" is excluded and available, if at all, only as a separately quoted upgrade or paid add-on.

3.1 Website Design: Included (Basic): One (1) standard, template-based website of limited size. Not Included: Custom UX/UI design, custom illustration, large or unlimited page counts, dynamic functionality, databases, member logins, e-commerce/checkout systems.

3.2 Premium Hosting: Included (Basic): Basic shared hosting on infrastructure shared among many other Pink Gorilla clients. Not Included: Dedicated servers, VPS, dedicated IP addresses, guaranteed uptime/SLA.

3.3 SSL & Security: Included (Basic): A basic, standard SSL certificate and baseline, automated security measures. Not Included: Premium/EV certificates, dedicated firewalls, advanced threat monitoring.

3.4 Continuous Dev: Included (Basic): Occasional, minor, at-our-discretion updates such as small bug fixes. Not Included: New features, new pages beyond the Basic limit, rebuilds, custom development.

3.5 ADA Support: Included (Basic): Baseline accessibility configuration using standard tools. Not Included: Any guarantee, certification, or warranty of compliance with the ADA, WCAG, or any other accessibility law.

3.6 The Pulse Report: Included (Basic): A standardized, automated, monthly summary report containing basic analytics metrics. Not Included: Custom analytics, bespoke dashboards, strategic consulting.

3.7 Domain Mastery: Included (Basic): Standard domain connection, DNS configuration, and automated renewal management for one (1) domain. Not Included: Multiple domains, premium domains, domain purchases.

3.8 Business Email: Included (Basic): One (1) single, limited business email mailbox on a standard, shared, basic email service. Not Included: Additional mailboxes, aliases beyond standard limits, large or unlimited storage.

3.9 Brand & Logo: Included (Basic): One (1) basic logo concept and simple branding identity, produced from templated or standardized design assets. Not Included: Full brand strategy, multiple logo concepts, unlimited revisions.
